The Australian government is likely to announce new visa requirements for Australian student visa (subclass 500)  holders in July, according to NRI Affairs. So today we are discussing things you need to know about the Australia student visa news which is yet to be published.

The Australian student visa (subclass 500) is a five-year temporary visa that allows you to study in Australia. As a temporary solution, students can attend an appropriate course of study, travel in and out of the country, and work restricted hours in any field.

International students may find it more difficult to alter courses or quit their colleges under the new Australia Student Visa 2022 guidelines, which took effect on July 1. Under a new rule, international students in Australia can only alter their courses with the Minister’s permission.

So, what is behind the latest Australia student visa news?

The Minister must be satisfied that the visa holder poses no excessive risk of transferring key technology to another country.

What is critical technology?
Any technology of a kind indicated by the Minister for the reasons – of this definition; or Property or any kind of (physical or digital) that is part of; or a result of; or used for the purposes of researching, testing, developing, or manufacturing; any technology of a kind specified by the Minister for the purposes of this definition.

The Australia Student Visa may be terminated if the Minister determines that there is an undue danger of an unwanted technology transfer.

Any direct or indirect transmission of essential technology by a person is considered an undesired transfer of crucial technology.

Transfer of critical technologies; or transfer of essential technology information; by someone who would

Damage or hinder Australia’s security or defense, including domestic intelligence agencies’ activities, capabilities or technology, techniques, or sources; and public authorities or foreign intelligence agencies (within the meaning of the Criminal Code);
Cause injury or prejudice to the Australian public’s health and safety, or any portion of it; or obstruct or prejudice the prevention, detection, investigation, prosecution, or punishment of a criminal offense under the Commonwealth Act; or International relations harm or injury to Australia.

Updated rules for Australia Student Visa 2022

Student visa holders who are enrolled in higher education or postgraduate research program and wish to modify their course of study, thesis, or research topic will be subject to the new visa restrictions 8204A and 8204B. Otherwise, the Department of Home Affairs in Australia may terminate your student visa.

The following are the new visa criteria, as specified on the Australian law’s website:

8204A: A student visa holder may not modify their course of study, thesis subject, or research topic unless they:

The Minister is satisfied that there is no excessive danger of the holder transferring crucial technology without permission, and the amendment has been granted in writing.

8204B: A student visa holder may not begin or modify a course of study, research, thesis, or research subject for the following reasons:

a graduate certificate, diploma, master’s degree, or doctorate; or any bridging course required as a requirement to a master’s degree or doctoral course of study or research; unless:

The Minister is satisfied that the holder poses no undue risk of unintentional transfer of key technology; and the Minister has authorized in writing the holder’s undertaking or change of study or research.

What Impact Will Changing Your Course of Study Have on Your Student Visa in Australia?

• Previously, overseas students may only change their course for six months or longer with their educational institution’s consent.
• The Minister will be able to refuse to authorize an overseas student’s desire to change courses in the public interest under the new guidelines. According to the article, Australian student visa holders can still appeal the Minister’s decision.
• Only student visas issued after July 1, 2022, are subject to the new visa criteria. The new judgment will not impact applications submitted prior to this date.
• For a graduate certificate, graduate diploma, master’s degree, or Ph.D., international students must not change their course of study or research subject without the Minister’s consent, and a bridge course may be required as a precondition.
• Let’s say your request to change courses is denied. In such an event, cancellation of relevant visas’ (certain protection visas and associated bridging visas) will be optional but required for all other visa categories.

Form 1221 must be completed and submitted to Adelaide.student.centre@homeaffairs.gov.au by students who are planning to switch their thesis, major, or research topic.
